TERMS AND CONDITIONS
Exhibitor acceptance is a first come first serve basis and based on attendance during the scheduled hours of May 4, 2018, with payment due at time of Application Submission. No refunds will be given for exhibitor cancellations.
Every effort shall be made to operate the event. If the event is altered/cancelled prior to the start date the space fee will be adjusted/refunded. Should the Niagara Folk Arts Festival deem it necessary to cancel or alter the operation of same in any way, the Niagara Folk Arts Festival will not provide any compensation for loss of income.
This agreement may be terminated by the Niagara Folk Arts Festival at any time on the breach of any of the conditions hereof by the Vendor, and thereupon all its rights hereunder shall cease and terminate, and any payments made by it on account hereof prior to the termination shall be retained by the Niagara Folk Arts Festival as liquidated damages for such breach, and the Niagara Folk Arts Festival may thereupon reassign said space.
The Niagara Folk Arts Festival is a family friendly event which works to ensure there are a variety of items that are affordable by the general community. Items must appeal to a multi-cultural audience and along with pricing, be approved in advance. The Niagara Folk Arts Festival may remove any items it deems not acceptable or are outside of the pre-approved description provided. Items considered inappropriate include but are not limited to: Pornographic material; Items encouraging alcohol or drug use or the use of weapons; Racist or sexist material; Vulgar or abusive language; Political or cause marketing. Sales permits and collection of all appropriate sales tax and any labeling required by law is the sole responsibility of the vendor.
All vendor sites have been specifically laid out to ensure equitable sight lines and to facilitate the flow of pedestrian traffic. Vendors may not intrude into the pedestrian traffic area and will remain within the parameters you applied for. If you choose to occupy more space than you requested and previously paid for, you will be charged immediately, for the larger space. This fee is due immediately or you will be required to remove product from the extra space.
BOOTH PLACEMENT PRIORITY
Booth placement will be based on space and sight lines as determined by The Folk Arts Festival. Subletting the whole or any part of the space hereby contracted for is not permitted. The Niagara Folk Arts Festival reserves the right to relocate exhibits. Please note live or recorded music will not be permitted. Entertainment will be produced from designated stages.
BOOTH SET UP AND STRIKE
Each vendor will set up and maintain, market, operate, take down and remove their own booth from the space provided to them. Load in will be 8am Saturday May 4, 2019. Absolutely no staking is allowed. TEAR DOWNS ARE NOT PERMITTED PRIOR TO 6PM ON Saturday, May 4, 2018.
SITE PREPARATION - NO VEHICLES ALLOWED INSIDE THE VENDOR AREA.
PLEASE MAKE LOADING AND UNLOADING PREPARATIONS FROM THE DROP OFF AREA ONLY. VOLUNTEERS MAY NOT BE AVAILABLE.
Participating vendors must be covered with a $2 Million Insurance Policy and provide the Niagara Folk Arts Festival with a Certificate of Insurance naming, the Niagara Folk Arts Festival and the City of St. Catharines as additional insured to the commercial liability rider of the vendor's policy. Only as a suggestion, PAL Canada does have an
Exhibitor/Vendor Booth & Kiosk Liability policy
that is available for 30 days for $50.00. The Festival does not receive any monies from PAL Canada, and vendors are free to utilize whatever insurance provider they wish.
BOOTH AND RENTAL DEFINITIONS
You are a reputable, well established business that intends to offer merchandise for sale. You will provide vendor insurance and will be promoted as a Marketplace Vendor on social media advertising. You agree to equally promote the Niagara Folk Arts Festival.
Artisan Volunteer Vendor:
You are a small craft or artisan vendor that is not yet established and is in a growing stage. All Volunteer Artisans on site will register a Volunteer Application. Your efforts for the day will be considered in a Volunteer capacity to aid the Festival in its overall Programming appeal. Volunteer Artisans will be permitted to sell merchandise, and will be required to use existing social media to promote the Festival.
You are a not for profit agency that will not be selling any merchandise. Community Booths are permitted to offer hand-outs or information relevant to their role in the community. You will provide proof of insurance.
Cultural Club Booth:
You are a not for profit Cultural Club member of the Folk Arts Multicultural Center that will offer hand-outs or information relevant to your role in the community, and will be permitted to sell non-food items, with pre-approval of the Festival Office. You will provide proof of insurance.
Rental of 2 chairs and 1 table:
The rental of tables and chairs are for one/both days, and come in sets of 2 chairs and 1 table.
RECYCLING, GARBAGE AND SITE CLEAN UP
Vendors are responsible to sort and classify all garbage for recycling. Vendors must leave their sites as they found it, clear of all garbage and recyclable materials. Failure to do so may result in additional charges to help offset the clean-up costs incurred by the Festival. The Festival garbage cans and recycling bins will be maintained on a continuous basis throughout the Festival. Upon completion of the Festival, vendors are responsible for removing their equipment and waste and returning their site to its pre-festival condition. This must be completed immediately upon the closing of the Festival on Saturday, May 4 by 11:00 pm. The Festival is not responsible for any loss or damage to the site.
PARKING PERMITS AND DRIVING RULES
Pedestrian and community safety along with Festival image is our highest priority. Driving inside the vendor area AT ANY TIME is banned and there will be a limited space and time duration for the Vendor Drop off area. Any vendor who breaks the parking and driving rules may have their space cancelled without notice and their fee forfeited as liquidated damages to the Festival. Vehicles illegally parked during the Festival may be ticketed and towed at the expense and liability of the registered owner. There isn’t any designated vendor parking, though all Municipal parking lots and parking meters are free from Friday 6pm until Monday 6am.
The Festival will operate rain or shine according to the posted scheduled Hours of Operation. There are no refunds for use of space as a result of inclement weather.
Each vendor indemnifies the Niagara Folk Arts Festival, its management team, its volunteers, and the City of St. Catharines from any litigation resulting from any loss or damage that they may incur to them as a result of their being accepted and operating a booth at the Festival for any reason.
The Niagara Folk Arts Festival is not responsible for any loss or damage as a result of vandalism or an act of God.
At this time, vendors should be prepared to not have electricity provided or available. Certified generators and batteries or battery powered lighting is acceptable, (NO open flames), but must be approved by the Festival prior to April 20, 2018. Should electricity opportunities become available, the Festival will make this known to all vendors.
AGREEMENT TO MARKET
Each vendor will endeavour to market their participation in the Festival to their network to help increase attendance in coordination with the Festival when possible.
